I've been plagiarised!

I've gone through all the possible sources for the theft of my song, and have concluded that it can only be MacJams. (Nothing bad is implied re MacJams here. Only of those trawling for inspiration.) I'll hold off naming names until the parties concerned have had chance to respond to requests concerning the origin of their "cover." If they are good people they will admit to nicking most of the song (chords, lyrics, bass line) and if not then they can prepare for some vilification.

Did you register a US Copyright, and include the proper © Copr. notices when you posted your song?   When you send a cease-and-desist letter and they reply “innocent infringement,” would they have a case?

If you “own clear title” to the song, and then as the lawful owner voluntarily elected to post it here – or, anywhere – then the site(s) upon which you posted it have no control over someone then appropriating a copy of the sound-file, lyrics and so on ... nor should they, as you apparently intended that “arbitrary visitors” should be able to do these things.   But, if you “minded your P’ and Q’s,” you do have the legal privilege to enforce your copyright.   You can, for instance, fairly easily force the offending works to be taken down.   “I claim that this song infringes on my copyright, US registration #1234567,” and, boom, it will be gone.

(Copyright registration is not, strictly speaking, required ... but it sure is worth the $35.)

P.S.:   Song files also have metadata – including copyright notices, which will be displayed by most players.   Both Logic and GB can insert them into your rendered outputs.   This is legally recognized as a form of “notice” and it should always be there.

Hey G, this happens, more than we know because often the material posted is used in a limited manner we will never be aware of... There is not much you can do about the situation.

The idea is the people who have stolen from you are not going to provide you relief unless you have a hammer to hit them with... They will ignore you. The troll gave you the book answer. He has no idea how the real world functions.

IF they are pissing you off enough to warrant you becoming litigious prepare for a long and expensive fight, I can tell you from personal experience at the bottom of the wishing well there is a pair of ladies panties and an smile from your attorney. The people who are most likely to use your intellectual property without permission have nothing from which you can recover damages anyway... but if you can threaten them you might get some satisfaction lol?

The admin at YouTube or some social media platform may listen to your complaint. Without more information I would not venture further comment.

Actually, Daugrin, if(!!) you have a (objectively-provable ...) previously-registered United States Copyright™, the process of “taking them down” is actually very straightforward – no site-owner is going to dare(!) to challenge you.   But, as you say, “actually getting money from the ‘perps’ ...” yeah, good luck with that.

And – it is worth re-repeating – “innocent(!) infringement“ continues to be a very valid defense:   did the perpetrators actually intend to cause material harm to you?   Did they know?   Or were they merely stupid ... and in fact did no material damage to your objectively-itemizable business interests?   Any “objective trier of fact” is going to be looking very-hard at such things . . .

Glad to hear Graham that it was a misunderstanding.

But such plagiarisms do happen.

I've had my online persona swiped twice now. Years ago I went by Amagi... a name which came with a specific historical origin and a specific political slogan. All of it was appropriated by a group of punkish penis size obsessed Neanderthals located in the UK. Not a damn thing i could realistically do about it.

More recently someone has swiped Calchas.

I suppose that until I officially release an album under an unused name I have no real protection.

I see you've misunderstood my comment entirely. Partly my fault. I'm sorry that I was less than fully and perfectly clear. But hey, at least it gave you an opportunity to vent your rage, right?

I could go off on how the polarized---like a double seeing drunk---never understand simple, much less complex situations aright. But I've tried to do that here before and the effort only met with uncomprehending rage and/or extremist political-speak. I frankly don't have the energy for that sort of thing anymore. So I will forgo...

In the meantime, the Left (the source of most of the horror that was the 20th century) almost exclusively controls education and the media, to say nothing of the entertainment industry; and the wider culture continues to spiral into the abyss of moral, political and philosophical barbarism. Cause and effect.

Yikes....

As a musician, i have learned the very hard way to keep my leanings, faith, ideologies, politics and personal opinions to myself. It alienates the listener, and can sometimes create an adversarial relationship between artist and potential fan.

Having spent time abroad, i can safely say, the USA doesn’t have all the answers. Hell, they often refuse to even ask the right questions. In times of trouble and turmoil, Best to sit back, write a good song, and leave the discourse to more idle hands, in my humblest and most respectful of opinions....
